Spa World offers Free Kerbside drop-off delivery on Fisher E series portable spas in New Zealand. The following are the terms and conditions of this offer.

  1. Introduction

These terms and conditions govern the curbside drop-off delivery service for Fisher E Series spa pools ("Product") provided by Spa World Limited ("we", "us", "our") to customers ("you", "your") within a 50 km radius of our showroom locations in New Zealand ("Eligible Delivery Zone").

  1. Delivery Service

Curbside Drop-Off: Our FREE delivery service includes curbside drop-off only. The Product will be delivered to the closest point to your premises that is accessible by our delivery vehicle. In most cases curbside delivery is most easily defined as the driveway leading into your property that is easily accessible from the road and is a flat and stable surface.

Exclusions:

  • Swim Spas and Plunge Pool
  • Non-Fisher E Series products
  • Placement of the Product into its final location,
  • Unwrapping of the product or packaging removal.

Service Area: This service is available only within a 50 km radius of our showroom locations. Deliveries beyond this radius are subject to additional charges and conditions.

  1. Delivery Charges

If FREE Curbside Drop-off Delivery is selected at the time of sale and if the delivery qualifies for FREE Curbside Drop-off Delivery, the Delivery is Free of charge. Any special requirements may incur additional charges.

  1. Scheduling and Delivery Times

Deliveries are scheduled in advance. We will provide you with a delivery window, which must be agreed upon at least 7 days before the delivery date. While we strive to adhere to scheduled delivery times, unforeseen circumstances may cause delays. We do not guarantee exact delivery times and are not liable for any losses incurred due to delivery delays. Authority to Leave(ATL): If you are not available to be on site during the delivery, you will be required to sign an ATL and provide information about the dropoff location.

  1. Preparation and Access

You are responsible for ensuring that the delivery location is accessible and free from obstructions. This includes securing all necessary permissions for delivery access where applicable. We are not responsible for deliveries that cannot be completed due to access or space limitations. The Product will be returned to the warehouse and you will be charged for any subsequent re-delivery.

  1. Inspection and Acceptance

Upon delivery, you are responsible for inspecting the Product for any damages or discrepancies. Any issues must be reported to the delivery team immediately. Acceptance of the Product transfers the risk of loss or damage to you, except in cases of negligence on our part.

  1. Cancellations and Returns

Delivery cancellations must be made at least 48 hours before the scheduled delivery time. Cancellations made less than 48 hours before delivery may incur a cancellation fee.

  1. Liability

Our liability for the delivery service is limited to the delivery fee paid by you. We are not liable for indirect or consequential losses resulting from delivery service delays or failures.

  1. Changes to Terms

We reserve the right to modify these terms and conditions without prior notice. The latest version will always be available on our website.

  1. Governing Law

These terms and conditions are governed by the laws of New Zealand. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of New Zealand. By placing an order for Curbside Drop-Off Delivery, you agree to these terms and conditions.
